box-sizing: border-box; min-height: 1em; text-indent: 2em;"><font face="微软雅黑" size="3"><span style="outline: 0px; max-width: 100%; box-sizing: border-box; color: rgb(247, 223, 21);">●</span><span style="letter-spacing: 1.8px;">最近，市民郭女士向三秦都市报反映，国庆假期期间，10岁的儿子用自己的苹果手机偷偷给游戏充值了2万余元，联系苹果客服和游戏开发商均没有结果，不知如何才能退回这部分钱。</span></font></p><p style=""><font face="微软雅黑" size="3"><br></font></p><p style=""><font face="微软雅黑" size="3"> 记者从郭女士展示的充值记录上看到，短短几天时间，这部手机的充值次数高达三十余次，除了少数单次几十元的充值记录外，其余单次金额是清一色的648元。郭女士告诉记者，她是收假后发现账单不对劲，于是向苹果客服咨询，一查才发现儿子在《贪吃蛇大作战》《斗罗大陆：魂师对决》《和平精英》《汤姆猫跑酷》4款游戏里偷偷充了钱。随后，她向苹果客服投诉，要求退还充值金额，两次申请苹果官方客服回复均为“我们审核了您的申请，您的购买项目不符合退款条件”，未说明具体理由，并建议联系游戏运营商解决。</font></p><p style=""><font face="微软雅黑" size="3"><br></font></p><p style=""><font face="微软雅黑" size="3"> “网络游戏说是都有实名认证，但是如果只是提供身份证号，不做人脸识别，那这个实名认证不是形同虚设吗？”郭女士说，自己10日开始一直联系这些运营商，但都没有客服电话，只通过网站机器人客服和微信公众号回复。目前《贪吃蛇大作战》游戏客服说退金额的50%，《斗罗大陆：魂师对决》游戏客服要求提交未成年人保护申诉，她提交资料后至今也没有消息。随后，记者通过相关微信公众号联系客服，公众号均为自动回复要求提供相关资料。</font></p><p style=""><font face="微软雅黑" size="3"><br></font></p><p style=""><font face="微软雅黑" size="3"> 记者查阅相关资料发现，2020年5月19日，最高人民法院印发《关于依法妥善审理涉新冠肺炎疫情民事案件若干问题的指导意见（二）》的通知，规定限制民事行为能力人未经其监护人同意，参与网络付费游戏或者网络直播平台“打赏”等方式支出与其年龄、智力不相适应的款项，监护人请求网络服务提供者返还该款项的，人民法院应予支持。</font></p><p style=""><font face="微软雅黑" size="3"><br></font></p><p style=""><font face="微软雅黑" style="" size="3"> 不过尽管有相关明文规定，但落到实处却并不容易。一位不愿透露姓名的业内人士告诉记者，由于家长难以举证充值是未成年人的行为，因此很多退款都会被拒绝，部分游戏运营商会退还部分金额，但具体也没有一个统一标准，“因为这类情况小孩充值肯定都是背着家长，家长肯定很难提供证明，不过充值时间或者玩的游戏明显与未成年人学习生活规律相吻合，应该也可以作为证明。</font></p><p style="font-family: -apple-system, BlinkMacSystemFont, "Helvetica Neue", "PingFang SC", "Hiragino Sans GB", "Microsoft YaHei UI", "Microsoft YaHei", Arial, sans-serif;
