渭南一村民莲池多次遭污水冲入受损，法院判镇政府赔100余万元！结果......

15px;'>11月24日，提起为莲池被坊镇流过来的污水而连年打官司，合阳县洽川菜农王利心力交瘁。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;color: rgb(0, 82, 255);'>1998年，王利承包洽川镇南菜园村大片滩地，并挖了莲池种莲菜，每年的收成还不错。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>2012年，坊镇人民政府（以下简称坊镇政府）为排放街道生活污水，在该镇南伏蒙村西南临沟坡处修建雨污合流的污水处理站，</span><span style='font-size: 15px;color: rgb(0, 82, 255);'>污水处理后排至抽黄总干渠，有一段排水渠与王利承包滩地相邻。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>没想到，2015年开始，污水连年冲入莲池，导致莲菜受损。王利说，2015年5月至10月，因降雨增多排水渠被污水冲垮，水流裹着泥沙冲进王利的莲池，</span><span style='font-size: 15px;color: rgb(0, 82, 255);'>导致48余亩莲菜地受损。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>2016年9月，排水渠又被冲垮，雨污水再次冲进莲菜池，导致受损面积扩大，164余亩莲菜地受损。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>2017年5月至10月，排水渠又被泥沙堵塞，渠道破裂，导致泥沙和污水再次进入莲池沉积，莲菜地损毁190亩。2017年至2019年，这190亩莲池被雨污水充溢，王利也未种植及收获莲池。</span></section><section><br></section><section style='line-height: 2em;'><span style='color: rgb(171, 25, 66);font-size: 16px;'><strong>5年间多次起诉法院判赔上百万 镇政府仅支付10余万元</strong></span></section><section><br></section><section style='line-height: 2em;'><span style='font-size: 15px;'>为挽回2015年的损失，2016年6月王利起诉坊镇政府，</span><span style='font-size: 15px;color: rgb(0, 82, 255);'>此后，该案经历不服上诉、发回重审、对重审不服再上诉的复杂历程。</span><span style='font-size: 15px;'>2018年11月28日，渭南市中级人民法院做出终审判决：坊镇政府赔偿王利各项损失7.5万余元。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>2017年9月，王利又起诉坊镇政府，要求赔偿2016年莲菜损失，合阳县人民法院判决坊镇政府赔偿损失16万余元。此次判决后，王利未上诉。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>“这两次判决以后，我申请执行。法院判赔23万多，实际上坊镇政府只给10余万元。”王利说，剩余的赔偿也曾多次索要，但坊镇政府再未支付。</span></section><p><span class="wxart_image" wx-style='display:inline-block;box-sizing: border-box;outline: 771px;'></span></p><section style='line-height: 2em;'><span style='font-size: 15px;'>2020年4月，王利再次起诉坊镇政府，要求修建排污排水渠、停止侵害，恢复莲池原状，并赔偿2016年至2019年的莲菜损失等。2020年12月19日，</span><span style='font-size: 15px;color: rgb(0, 82, 255);'>合阳县人民法院判决，坊镇政府向王利支付修复费、损失等共78.1万余元。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>王利不服上诉，今年5月31日渭南市中级人民法院作出终审判决，驳回上诉、维持原判。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>王利说，渭南市中级人民法院这次判决后，他去找过坊镇政府协商。镇上有干部，说会把以前的判决一并解决，最近正在研究，他就没申请执行。近日，坊镇政府派机械将渠道已经疏通，污水不再流到他承包的地里。</span></section><section style='line-height: 2em;'><br></section><section style='line-height: 2em;'><span style='color: rgb(171, 25, 66);font-size: 15px;'><strong>坊镇政府镇长：对方所诉与事实有出入 正收集证据准备抗诉</strong></span></section><section><br></section><section style='line-height: 2em;'><span style='font-size: 15px;'>11月25日，华商报记者联系到合阳县坊镇政府镇长张徐华，他说，自己刚到坊镇工作不久，最近正对此情况进行了解。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>“已经安排机械将原先的水路挖开了，水再不会流到他的地里。”对于王利提起的诉讼，他说，出现损毁的水渠是附近一个村子的，归属权并非镇上，该镇只是使用这一渠道，渠道出现问题污水进了地，王利应该起诉水渠归属权的村子，不应起诉坊镇政府。</span></section><p><span class="wxart_image" 15px;'>律师观点：申请抗诉不影响判决执行 当事人可申请强制执行</span></strong></span></section><section><br></section><section style='line-height: 2em;'><span style='font-size: 15px;'>陕西赛高律师事务所资深律师邓建军认为，坊镇政府既然对王利的说法存疑，在当时的审判过程中就应提出异议并举证。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>对于坊镇政府的说法，邓建军表示，按法律规定，当事人对已经发生法律效力的判决、裁定，认为有错误的，可以向上一级人民法院申请再审。如果坊镇政府有证据证明此前判决有错误，可以依法申请再审或申请抗诉，但申请再审不停止判决、裁定的执行。</span></section><section style='line-height: 2em;'><span style='font-size: 15px;'>邓建军表示，如果申请再审或抗诉成功，法院会出具相关书面文件来中止原判决的执行。从目前的情况来看，相关的判决均已经生效，王利可以向法院申请强制执行，来确保自身的合法权益得到落实。</span></section><section style='text-align: center;'><span style='font-size:
