box-sizing: border-box;">青浦区检察院介绍，2012年，21岁的柯慧琴与劳凌相识，并于当年底在老家登记结婚成为合法夫妻，婚后二人共同养育两名子女，直至2017年10月，柯慧琴随同劳凌一起到上海务工。</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px; box-sizing: border-box;">来到上海不久，柯慧琴偶遇了男子萧涵。萧涵2001年生，比柯慧琴小10岁，但性格沉稳，柯慧琴与他一见如故，不久便无话不谈。萧涵不知其已婚，两人经常相约外出、吃饭逛街。</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px; box-sizing: border-box;">2018年5月，柯慧琴与萧涵在外并肩行走时，偶然与劳凌迎面撞上。劳凌见妻子与其他男性举止亲密，当即雷霆大怒，回家后和柯慧琴大闹一场，强行将她带回老家。柯慧琴返回老家后不耐烦整日做饭带孩子，又对丈夫的行为感到愤怒，倍加思念萧涵，一怒之下，离家出走，返回上海。她自认为与丈夫分居就代表离婚，回到上海后找到萧涵与其同居。萧涵不明真相，由于其尚未到法定结婚年龄，且同样法律意识薄弱，便与柯慧琴同居，而未提及领证结婚事宜，因此也不知柯慧琴尚未离婚的真相。</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px; box-sizing: border-box;">柯慧琴与萧涵在一出租屋居住下来，该小区邻里关系和睦，见新搬来一户人家，便时常有人前来串门。柯、黄二人对外以夫妻相称，邻居们见他俩举止亲密，同进同出，交谈中对对方父母、工作情况都十分了解，只当这是一对合法夫妻。2019年6月，柯慧琴与萧涵产下一子。</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px; box-sizing: border-box;">幼子出生后，柯慧琴二人由于工作忙碌无暇照顾孩子，遂决定由柯慧琴将孩子带回老家与其父母共同照看。直至一年后孩子需要上户口，柯慧琴才想到要与劳凌办理离婚证，而当劳凌听说妻子这些年在外的经历后，毅然决定报警。</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px; box-sizing: border-box;">经审查，柯慧琴在有配偶的情况下与他人形成事实婚姻，其行为已构成重婚罪，依法应予惩处。然柯慧琴到案后如实供述自己罪行，自愿认罪认罚，且其子年龄幼小，不适合长期离开亲生母亲。因此，青浦区检察院依法对其提起公诉后，建议法院判处其有期徒刑八个月，并予以缓刑。法院已全部采纳检察机关量刑建议。柯慧琴户籍所在地法院也已判决准予其与前夫离婚。</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px; box-sizing: border-box;">检察官介绍，根据《中华人民共和国刑法》第二百五十八条之规定：有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px; box-sizing: border-box;">依照法律规定，我国婚姻实行一夫一妻制度，如果违反将会构成重婚罪，追究刑事责任。重婚罪最常见的情况是事实重婚，即在法定婚姻关系存续期间又与配偶以外的异性以夫妻名义同居生活。那么重婚罪是如何定义的呢？</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px; box-sizing: border-box;">首先，是以夫妻名义共同生活的认定。同居双方主观上具有永久共同生活的目的性，为了组建家庭而长久在一起。其中养育子女就能够直观表达双方长久共同生活的意愿，是认定双方构成同分重婚罪的重要依据。同时，双方拥有共同的经济基础，且同居期限存在长期性稳定性，则可认定为重婚。</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px; box-sizing: border-box;">其次，是以夫妻名义对外公开的认定。双方在公开场合及人际交往中向亲朋好友表明双方的夫妻身份，并以夫妻身份参加各类活动。公开的言语间以夫妻相称（言语公开身份是重要依据，但不是唯一依据），具有以上特征者也可认定为重婚。</p><p style="font-size: 16px; box-sizing: border-box;"><br></p><p style="font-size: 16px;
