上海市锦天城（西安）律师事务所刘江浩律师说，地热资源是一个城市重要的自然资源，违规超采、出售地热水的行为，不仅容易导致地面沉降、热污染、热资源浪费错配等环境问题，偷卖地热水即未经批准对外销售地热水的行为更属于违法行为，明显违背《西安市地下水资源管理条例》第十四条第二款之规定，应当承担该条例二十九条规定的责令改正、罚款，拒不改正的应吊销取水许可证等法律责任。另外，该条例十二条明确规定取用地下水本身应当缴纳水资源费，该案中取用主体是否缴纳了水资源费，超采部分的水资源费是否已经缴纳，违法销售收入的多少都应作为处罚时考量的维度。</span></p><p><span 北京市京师(西安)律师事务所律师黄竞之说，这起事件中，有关部门应该对相应获利展开调查，以更准确地确认其行为后果。根据《水法》第六十九条的规定，县级以上人民政府水行政主管部门或者流域管理机构可依据职权，责令停止违法行为，限期采取补救措施，处二万元以上十万元以下的罚款。根据《刑法》第三百四十三条来看，视本案具体情节，参考其非法收入金额，资源破坏程度，严重的或将构成非法采矿罪，除退缴犯罪所得外，还要承担相应刑事责任。矿产不只限于固体，水资源实际上也属于矿产资源的一种。
