51);'>近期，随着优化调整疫情防控相关措施的出台，部分抗病毒药品、相关防疫医疗器械用品等成为社会关注和消费者购买的热门商品。为进一步规范全省相关防疫类药品及防疫用品价格行为，维护消费者合法权益和市场价格秩序，现依法提醒告诫如下。</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>一、各相关经营者应当严格遵守《中华人民共和国价格法》《价格违法行为行政处罚规定》《明码标价和禁止价格欺诈规定》《陕西省价格条例》等法律法规规定，主动增强社会责任感，依法合规经营，自觉维护市场秩序和群众利益，配合政府相关部门做好市场保供稳价工作。</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>二、各相关经营者应当遵循公开、公平和诚实信用的原则，切实加强价格自律，正确行使自主定价权，准确核定生产经营成本并做好记录，为消费者提供价格合理的口罩、抗病毒药品、消毒杀菌用品、相关医疗器械等防疫类药品用品，不得扰乱正常的市场价格秩序。</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>三、依法禁止经营者有下列不正当价格行为：</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>（一）相互串通，操纵市场价格，损害其他经营者或者消费者的合法权益；</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>（二）捏造、散布涨价信息，哄抬价格，推动商品价格过快、过高上涨，扰乱市场价格秩序；</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>（三）利用虚假的或者使人误解的价格手段，诱骗消费者或者其他经营者与其进行交易；</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>（四）不按规定执行明码标价、价格公示制度，虚构原价、误导性价格标示、标价之外加价出售商品或收取未标明的费用等；</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>（五）除生产自用外，超出正常的存储数量或者存储周期，大量囤积市场供应紧张、价格发生异常波动的商品，推动商品价格过快、过高上涨；</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>（六）法律、行政法规禁止的其他不正当价格行为。</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>四、根据《价格法》及《价格违法行为行政处罚规定》等法律法规规定，经营者违反明码标价规定的，责令改正，没收违法所得，可以并处5000元以下的罚款；有价格欺诈行为的，最高可处50万元罚款；对捏造、散布涨价信息，哄抬价格，囤积居奇，推动商品价格过快、过高上涨行为的，最高可处300万元的罚款；对相互串通，操纵市场价格造成商品价格较大幅度上涨的，最高可处500万元的罚款。</span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'><br></span></p><p style='line-height: 2em;'><span style='font-size: 16px;color: rgb(51, 51, 51);'>五、本提醒告诫书发出后，各相关经营者要认真对照要求，积极主动开展自查，进一步规范自身价格行为，各级市场监管部门将持续加强对防疫类药品及防疫用品价格的市场监管执法力度。经本次提醒告诫后，对于借疫情防控之机串通涨价、哄抬价格、价格欺诈、囤积居奇等扰乱市场秩序的违法行为，一经查实，市场监管部门将依法从严从重从快处理，对情节恶劣的典型案件，向社会公开曝光。</span></p><p
