text-indent: 32px; line-height: 1.75em;"><font face="微软雅黑" size="3">一、根据《中华人民共和国药品管理法》相关条款规定，生产经营销售药品需取得《药品生产许可证》、《药品经营许可证》，严禁个人以任何形式生产经营药品。凡未取得药品生产许可证、药品经营许可证或者医疗机构制剂许可证生产、销售药品的行为，责令关闭，没收违法生产、销售的药品和违法所得，并处违法生产、销售的药品货值金额十五倍以上三十倍以下的罚款;货值金额不足十万元的，按十万元计算。构成生产销售假劣药品行为或非法经营的，将依法将追究刑事责任。</font></p><p style="text-align: left; text-indent: 32px; line-height: 1.75em;"><font face="微软雅黑" size="3">二、根据《医疗器械监督管理条例》相关条款规定，严禁个人以任何形式生产经营医疗器械。凡生产经营医疗器械的需取得《医疗器械生产许可证》《医疗器械经营许可证》。凡未取得医疗器械生产经营许可证销售医疗器械的行为，有下列情形（1）生产、经营未取得医疗器械注册证的第二类、第三类医疗器械；（医用口罩、医用防护服属第二类、新型冠状病毒抗原检测试剂属第三类医疗器械）（2）未经许可从事第二类、第三类医疗器械生产活动；（3）未经许可从事第三类医疗器械经营活动。执法人员将没收违法所得、违法生产经营的医疗器械和用于违法生产经营的工具、设备、原材料等物品；违法生产经营的医疗器械货值金额不足1万元的，并处5万元以上15万元以下罚款；货值金额1万元以上的，并处货值金额15倍以上30倍以下罚款；情节严重的，责令停产停业，10年内不受理相关责任人以及单位提出的医疗器械许可申请，对违法单位的法定代表人、主要负责人、直接负责的主管人员和其他责任人员，没收违法行为发生期间自本单位所获收入，并处所获收入30%以上3倍以下罚款，终身禁止其从事医疗器械生产经营活动。构成生产销售假劣药行为或非法经营的，将依法将追究刑事责任。</font></p><p style="text-align: left; text-indent: 32px; line-height: 1.75em;"><font face="微软雅黑" size="3">三、凡通过微信朋友圈、微信群等非正规渠道购买药品和医疗器械，药械质量安全不仅无法保证，由于个人隐私限制，也给追溯和维权带来较大困难。在此温馨提示广大消费者要通过合法渠道、正规药械经营单位购买药品医疗器械，并保留销售凭证作为维权依据。</font></p><p style="text-align: left; text-indent: 32px; line-height: 1.75em;"><font face="微软雅黑" size="3">四、各级市场监管部门会同各级公安机关将持续加大全市药品和医疗器械的全链条全环节监管执法力度，针对疫情防控期间涉药品医疗器械违法犯罪行为，始终保持严打高压态势。对日常检查、监督抽查、投诉举报、网络监测等渠道发现的问题线索要追根溯源、一查到底；发现存在违法违规行为的，予以立案查处；涉嫌刑事犯罪的，移送公安机关追究其刑事责任。</font></p><p style="text-align: left;
