离婚后未及时过户，前妻把房屋抵押贷款无法偿还，父子俩住房面临拍卖

letter-spacing: 0.034em;" mpa-font-style="mkuhjrgdcxd">“我去给她做抵押贷款的银行了解情况，发现她离婚后于2022年12月买了一家公司，成为一家公司的法定代表人。2023年4月前，她把剩余的40多万元房贷还清；2023年5月，她以房屋做抵押在一家银行办理了贷款。这套房当时价值210万元，她是以顶格贷款数额贷款138.9万元。贷款用途是用来装修一家美容院。而那家美容院注册地是我们小区公寓楼一个60多平方米的小两室住宅，装修这样的房子用得着138.9万元吗？何况这个房还是她租的。在银行给我出示的资料中，我发现其中一些明显是有问题的，比如离婚证是补办的，连我的名字都是错的，产权证也是补办的。”吴右说。</span></p><p style="margin-left: 8px;margin-right: 8px;"><span leaf="" style="color: rgba(0, 0, 0, 0.9); letter-spacing: 0.034em;" mpa-font-style="mkuhjrgdqvq">“随后我停止了给前妻转还房贷月供的钱，实际上等于我已经多给她付了一年多的房贷月供。2024年11月我去找前妻，表示让她给我90万元，这房子我不要了，我把孩子带走，用这钱再去给儿子买一套房。她不愿意，我降到了70万元，她还是不答应。随后，我将前妻起诉到未央区法院，请求将房屋产权判归于我，让前妻配合将房屋过户到我名下。2025年开庭时，她没有到庭答辩，法院审理后将该房屋产权判归于我，但因目前处于债务履行期内不具备办理转移登记的条件。银行抵押贷款今年5月就要到期了。届时如果前妻无法偿还贷款，我和儿子所住的房屋就有可能面临被拍卖的情况。”</span></p><p style="margin-left: 8px;margin-right: 8px;"><span leaf="" style="color: rgba(0, 0, 0, 0.9); letter-spacing: 0.034em;" mpa-font-style="mkuhjrgdpja">吴右向记者出示了他保存的结婚证、离婚证、盖有未央区民政局条章的《自愿离婚协议书》、2018年的不动产权证，以及他从银行看到的前妻补办的离婚证、2023年不动产权证照片。此外还出示了未央区法院的民事判决书，前妻所购公司的工商登记变更信息页面截图等。《自愿离婚协议书》“财产分割”栏中约定房和车归男方。2025年8月4日未央法院的民事判决书显示，判定这套房归原告吴右所有。吴右还提供了一份“举报材料”，认为银行没有尽到注意和监管义务，涉嫌违规放贷，造成其房产损失，要求将房屋予以解押。</span></p><p style="margin-left: 8px;margin-right: 8px;"><span leaf="" style="color: rgba(0, 0, 0, 0.9); font-family: 默认字体;"><strong><span leaf="" mpa-font-style="mkuhs6141lp" style="font-size: 16px;">陕西言锋律师事务所主任律师贾涛分析认为，离婚了就应该尽快去办理过户登记，但当事人没有及时办理，这是最大的问题。尽管离婚协议有明确约定，后来通过诉讼也确权了，房产归男方，但现在因为有抵押导致无法办理转移登记。“房屋这种不动产，产权证上登记的是谁，谁就是产权人。即便这个房子出钱人不是当事人，但因为登记的名字是当事人，人家就可以拿去贷款。作为产权人，就可以行使不动产权的四项权能，即占有、使用、收益、处分。”</span></strong></p><p style="line-height: 1.71; font-family: 默认字体;"><strong><span leaf=""><br></span></strong></p><p style="line-height: 1.71; font-family: 默认字体;"><strong mpa-font-style="mkuhs61412eu" style="font-size: 16px;"><span leaf="">从当事人讲述来看，虽然离婚协议约定房子是他的，但这套房子在他正式起诉确权之前已经被其前妻设置了抵押权，现在就只能看设置抵押权到底有没有问题，相应资料和证件是否合法，有无骗贷嫌疑。如果其前妻贷款手续都是真的，没有骗贷，把贷款拿了也用了，做生意赔了，当事人就只能让法院执行其房产了。按照民法典，担保物权优先于所有权的产生设置。抵押权属于担保物权，而银行有抵押权，所以优先于产权。</span></strong></p><p style="line-height: 1.71; font-family: 默认字体;"><strong mpa-font-style="mkuhs61412eu" style="font-size: 16px;"><span leaf=""><br></span></strong></p><p style="line-height: 1.71; font-family: 默认字体;"><strong mpa-font-style="mkuhs61422su" style="font-size: 16px;"><span leaf="">从夫妻共同财产角度来说，房子若是夫妻关系存续期间内购买的，即便登记在一方名下，也属于共同财产。如果是在婚姻存续期间做抵押贷款，银行一般会让夫妻双方一起去办理。但因为有了离婚证的存在，会让银行认为这可能就是一个人的财产。离婚证如果有问题，就涉嫌骗贷。“根据当事人的讲述，用来办理抵押贷款的离婚证上男方的名字不对，这是有问题的。这个离婚证是咋补办出来的，到底是不是虚假的？另外产权证也是补办的，这些补办有没有问题？若认为这个抵押是有瑕疵的或者涉嫌违法、犯罪，该报警就要报警。如果真是用了补办的假离婚证去办理贷款，则相当于伪造政府公文。”</span></strong></p><p style="line-height: 1.71; font-family: 默认字体;"><strong mpa-font-style="mkuhs61422su" style="font-size: 16px;"><span leaf=""><br></span></strong></p><p style="line-height: 1.71; font-family: 默认字体;"><strong mpa-font-style="mkuhs614vyo" style="font-size: 16px;"><span leaf="">对于银行来说，房屋抵押贷款应当提供完整的房产手续和相关资料。贷款人把自己名下的房产抵押当然没有问题，但银行要考虑到这是夫妻关系存续期间买的房，所以除了要求提供离婚证外，还应该要求提供离婚协议，来了解这套房的约定归属，把这些都查清了才可以按规定办理抵押贷款。如果办理抵押贷款的一些关键资料确实是虚假的或缺失的，可能会导致抵押贷款合同无效。</span></strong></p><p style="line-height: 1.71; font-family: 默认字体;"><strong mpa-font-style="mkuhs614vyo" style="font-size: 16px;"><span leaf=""><br></span></strong></p><p style="line-height: 1.71; font-family: 默认字体;"><strong mpa-font-style="mkuhs6141002" style="font-size: 16px;"><span leaf="">当事人吴右应该做的措施，一是起诉确权，确权后才能确认这个贷款到底是真是假，目前他已经确权了；二是在确权之后，继续起诉抵押贷款无效。同时，如果确实认为抵押贷款有问题还要报警，让公安经侦部门来确认到底有没有存在骗贷的行为。最后，在这种情况下，如果银行通过法院来执行房产拍卖，当事人一定要提出执行异议。如果抵押权最终被撤销或者被确认无效，那他就是享有物权的人。银行就只能找女方要求还钱，并不能以房产来优先还银行贷款。</span></strong></p><p style="line-height: 1.71;
