text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">新春佳节将至，为促进我县文旅市场游人如织，营造温馨、畅通、和谐的道路交通出行环境，让来澄游客感受澄城的温度与诚意，依据《中华人民共和国行政处罚法》《陕西省交通运输领域轻微违法行为依法免予处罚事项清单》等相关规定，结合我县交通运输执法工作实际，经研究决定，春节期间对来澄旅游客车实施轻微交通违法首违不罚人性化执法措施，现将有关事项公告如下:</font></span></span></p><p style="line-height: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;font-weight: bold;"><font face="微软雅黑" size="3">一、适用对象</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;background-color: rgb(255, 251, 0);color: rgb(255, 76, 65);"><font face="微软雅黑" size="3">春节期间凡驶入我县行政区域的外地籍旅游客车。</font></span></span></p><p style="line-height: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;font-weight: bold;"><font face="微软雅黑" size="3">二、适用时间</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;background-color: rgb(255, 251, 0);color: rgb(255, 76, 65);"><font face="微软雅黑" size="3">自2026年2月15日起至2026年3月3日(腊月二十八至正月十五)。</font></span></span></p><p style="line-height: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;font-weight: bold;"><font face="微软雅黑" size="3">三、适用情形</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">对来澄旅游客车属于首次实施违法行为、违法程度轻微且同时满足以下条件的车辆。我们将坚持教育为主、处罚为辅，依法予以提醒教育、责令改正，不予行政处罚:</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;background-color: rgb(255, 251, 0);color: rgb(0, 82, 255);"><font face="微软雅黑" size="3">(一)道路运输经营者使用卫星定位装置出现故障不能保持在线的运输车辆从事客运经营活动的。同时满足以下条件:</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">1.首次实施违法行为。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">2.违法行为调查过程中，不存在拒不接受执法部门调查处理、阻碍执法、煽动抗拒执法等妨碍执法公务的行为。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">3.卫星定位装置行驶途中出现故障不能保持在线，非客运输经营者行为所致。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;background-color: rgb(255, 251, 0);color: rgb(0, 82, 255);"><font face="微软雅黑" size="3">(二)道路运输经营者使用失效的道路运输许可证件从事道路客运经营等行为。同时满足以下条件:</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">1.首次实施违法行为。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">2.车辆在转籍、过户过程中许可证件失效5日(含)以内的。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">3.无逃避检查、阻碍执法等行为的。4.该行为未造成交通事故、交通拥堵、损坏公路路产等危害后果</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">5.非使用伪造、变造、被注销等无效许可证的。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">6.责令停止经营后停止的，并按管理部门要求积极办理延长许可手续的</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;background-color: rgb(255, 251, 0);color: rgb(0, 82, 255);"><font face="微软雅黑" size="3">(三)对客运经营者使用未持有合法有效《道路运输证》的车辆参加客运经营的。同时满足以下条件:</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">1.首次实施违法行为。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">2.违法为调查过程中，不存在拒不接受执法部门调查处理、阻碍执法、煽动抗拒执法等妨碍执行公务的行为。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">3.不存在涂改、伪造、编造《道路运输证》等违法行为。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">4.当事人能够及时提供相关有效电子证照。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">5.按执法部门要求为车辆办理道路运输证，且经评定，车辆符合相应的技术等级和类型等级。</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">6.违法行为被查处的同时，不存在超员超载或擅自改装等其他违法行为。</font></span></span></p><p style="line-height: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;font-weight: bold;"><font face="微软雅黑" size="3">四、工作要求</font></span></span></p><p style="line-height: 2em; text-indent: 2em;"><span leaf="" style=""><span textstyle="" style="letter-spacing: 1px;"><font face="微软雅黑" size="3">我县交通运输综合执法人员将严格落实首违不罚要求，规范执法行为、提升服务水平，在执法中做好政策讲解和暖心服务。同时，将加强重点路段巡查管控，全力保障春节期间我县道路交通秩序畅通有序，为广大游客和市民营造安全、舒心的出行环境。愿每一位来澄游客都能乘兴而来、满意而归，在澄城度过一个欢乐祥和的新春佳节!</font></span></span></p><p style="line-height: 2em;
