陕西全面落实带薪年休假制度

margin-bottom: 15px;'><span style='font-size:17px;'><span leaf="">通知明确，企业、民办非企业单位、有雇工的个体工商户等单位（以下称“用人单位”）和与其建立劳动关系的职工，连续工作满12个月以上的，享受带薪年休假。职工累计工作已满1年不满10年的，年休假5天；已满10年不满20年的，年休假10天；已满20年的，年休假15天。国家法定休假日、休息日不计入年休假的假期。职工在年休假期间享受与正常工作期间相同的工资收入。用人单位经职工同意不安排年休假或者安排职工年休假天数少于应休年休假天数，应当在本年度内对职工应休未休年休假天数，按照其日工资收入的300%支付未休年休假工资报酬。</span></span></p><p style='text-indent: 2em; margin-bottom: 15px;'><span style='font-size:17px;'><span leaf="">在鼓励引导用人单位与职工错峰休假方面，通知提出，用人单位要根据生产经营、工作岗位等具体情况，考虑职工本人意愿，科学统筹错峰休假与工作的关系，实现休假安排与生产经营有序衔接。对承担应急处置、民生保障等特殊工作任务的岗位，用人单位要提前谋划，制定错峰休假方案，精准平衡工作安排与职工休假权益。要引导职工根据个人实际，可分段灵活使用年休假，推动年休假与法定休假日、休息日、中小学寒暑及春秋假等有机结合，实际形成较长的“组合假期”，满足职工探亲访友、旅游休闲、家庭照护等多元化需求，有效实现错峰休假出行，提升职工休假和家庭生活品质。</span></span></p><p style='text-indent: 2em; margin-bottom: 15px;'><span style='font-size:17px;'><span leaf="">为全力推进休假政策落实，通知要求，各级人社部门要指导用人单位妥善处理生产经营与职工错峰休假的关系，畅通劳动保障咨询投诉举报渠道，将带薪年休假执行情况纳入劳动保障监察日常巡查检查范围。各级工会要结合实施涉工法律规定执行监督专项行动，依法维护职工的休假权利，加强对用人单位落实休假制度的监督，畅通“12351”工会职工服务热线，积极反映职工呼声；引导工会或职工代表与用人单位平等协商，将完善落实错峰休假制度相关内容纳入集体协商，写入集体合同。企业代表组织要积极引导企业经营者强化法律意识和社会责任，主动落实年休假制度，将错峰休假纳入构建和谐劳动关系的重要内容，推动用人单位和职工共同培育合作共赢、共谋发展的理念和文化，为职工错峰休假创造条件。</span><strong><span leaf=""><span textstyle='' style='font-weight: normal;'>（记者 白圩珑）</span></span></strong></span></p></section></section></section></section></section><section data-role="outer" label="edit by 135editor" data-pm-slice="0 0 []" style='-webkit-tap-highlight-color: rgba(0, 0, 0, 0);
