肇事逃逸是交通肇事罪的加重情节。要构成交通肇事罪的加重情节，首先要构成交通肇事罪对吧。
对于成立交通肇事罪构成要件，是死亡一人或重伤三人，且负事故的全部责任或主要责任。如果肇事者和死者负同等责任，则构不成交通肇事罪，逃逸的加重情节当然无法适用。
