style="color: #ff0000;">一、永久用地</span></strong></span></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">1．征地补偿费按综合价<span style="background-color: rgb(255, 255, 0);">45000元/亩</span>(含土地补偿和安置补助费)，涉及市、县（区）政府，管委会可结合当地实际情况细化分解并公布执行；城区和城市规划控制区按同区域同类在建重点项目补偿标准执行，城区和城市规划控制区以外未达到省政府公布的最低补偿标准的按照不低于公布的最低补偿标准执行。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">2．<span style="background-color: rgb(255, 255, 0);">林（草）地补偿费按综合价12000元/亩</span>（含土地补偿费、安置补助费和5%林地管理费）；退耕还林地补偿费按综合价40500元/亩（含土地补偿费、安置补助费、林木补偿费和5%林地管理费）。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">3．<span style="background-color: rgb(255, 255, 0);">青苗补偿费：1200元/亩。</span></span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><strong><span style="font-size: 15px;">4．砍移树木补偿费：</span></strong><span style="font-size: 15px;">砍移成片果树20000—40000元/亩；砍移成片景观树木20000元/亩；林（草）地成片林木（草坪）5000元/亩；其他土地上零星树木按3000元/亩综合价补偿。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><strong><span style="font-size: 15px;">5．建构筑物拆迁补偿：</span></strong><span style="font-size: 15px;">房屋（含窑洞）拆迁按土木房（含土窑）650—750元/平方米、砖木房750—850元/平方米、砖混房（含砖、石窑）900—1050元/平方米进行补偿，各市、县（区）政府，管委会可结合当地实际情况予以细化。其他建构筑物、苗圃、风景树拆迁及文件未明确规定的按当地县级以上政府现行补偿标准执行。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">6．<span style="background-color: rgb(255, 255, 0);">被拆迁户搬迁及过渡费5000元/户</span>，在规定期限内完成拆迁另增加奖励费5000元/户。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">7．被拆迁群众安置工作由当地政府负责，安置政策按当地县级以上政府现行安置政策及标准执行，自然资源部门负责补划宅基地安置用地。被拆迁户安置“三通一平”工程补助费7万元/户，由当地政府包干使用，采取集中或零散安置的方式切实解决好被拆迁群众的居住问题。上楼安置涉及相关费用应经省自然资源厅商有关各方共同确认。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">8．涉及企事业单位拆迁、国有土地补偿及特殊路段、特殊建构筑物拆迁补偿，由省自然资源厅商有关各方共同确定。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">9．因项目建设需要迁改的电力、通信、广播电视线路、管道、矿井、道路及水利设施，由市、县（区）政府，管委会组织产权单位拆除或迁移，按成本予以补偿。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">10．对违章建筑和到期的临时建筑不予补偿，依法拆除。对建设项目放线埋桩后违法违规抢建的房屋、设施和抢栽树木、抢种作物一律不予补偿。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">11．征地范围内现存的地表垃圾，按属地管理的原则由所在县（区）政府、管委会负责清理并承担相关费用；建设单位负责具体衔接工作并应做好用地交付后的铁路用地围护及监管工作，防止倾倒新的垃圾。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><strong><span style="font-size: 15px;color: #ff0000;">二、临时用地</span></strong></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">1．建设施工临时用地应尽量利用荒地和劣地。临时用地涉及青苗、地面附着物、建构筑物等补偿，参照永久用地补偿标准执行。</span></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">2．<span style="background-color: rgb(255, 255, 0);">取（弃）土、弃碴偿还用地补偿标准（建设工期内）为17000元/亩;铁路施工其他临时用地年补偿标准为1500元/亩</span>。</span></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">3．临时用地审批按照相关规定执行。临时用地单位应在当地自然资源部门及时办理临时用地手续，并签订相关临时用地协议。</span></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">4．临时用地复垦按照《土地复垦条例》（国务院令第592号）和《土地复垦条例实施办法》（原国土资源部令第56号）等有关规定执行。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><strong><span style="font-size: 15px;color: #ff0000;">三、铁路回收地</span></strong></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">铁路回收地依据铁路部门提供的国有土地使用证及相关资料确定，按6000元/亩综合标准补偿（含青苗及地面附着物补偿）。</span></p><p style="line-height: 1.75em;"><br></p><p style="line-height: 1.75em;"><strong><span style="font-size: 15px;color: #FF0000;">四、其他相关问题</span></strong></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">1．项目建设涉及占用耕地的，由项目建设单位与市、县（区）政府或自然资源部门签订补充耕地协议，在本行政区域内实现占补平衡；涉及易地补充耕地的，按照易地占补平衡有关规定办理。</span></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">耕地开垦费标准按照原省国土资源厅等三部门印发的《关于耕地开垦费征收管理有关问题的通知》有关规定执行。</span></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">2．征地拆迁工作经费，参照在建省级统征项目做法在征地拆迁费用中列支。</span></p><p style="line-height: 1.75em;"><span style="font-size: 15px;">3．耕地占用税按照《中华人民共和国耕地占用税法》《中华人民共和国耕地占用税法实施办法》及陕西省的有关规定执行。</span></p><p style="line-height: 1.75em;"><span style="font-size:
