color: rgb(171, 25, 66); box-sizing: border-box !important;'><strong style='max-width: 100%; box-sizing: border-box !important;'>法官提醒：</strong></span>因共同饮酒不是法律行为，且不具有违法性，也不是法律禁止的行为，故共同饮酒的人之间原则上不会产生法律上的权利义务关系。但是共同饮酒致死，共同饮酒人具备一定的条件还是需要承担一定的责任。首先，要判断共同饮酒人的饮酒行为是否是违法行为。当然，饮酒行为本身无对错，正常的饮酒是共同饮酒人之间联络感情的一种方式，并没有违反法律的强制性规定，因此饮酒行为并不必然具有违法性，只有在特定情形下，违反法定义务，其行为才具有违法性。其次，要看共同饮酒行为有无造成损害结果，侵权行为造成的损害结果是受害人要求行为人承担侵权责任的前提。再次，要甄别共同饮酒行为与损害后果之间有无因果关系，这是共同饮酒人承担责任的必须条件。死亡本身是很正常的自然现象，引起死亡的原因有很多，但是饮酒是否是死亡的原因，原因力的大小，是共同饮酒人承担责任的重要一点。同时，受害者作为完全民事行为能力人，对自己的身体状况有充分的了解，在饮酒时应当认识到过量饮酒对自己身体造成的危害，包括身体上的疾病发作以及醉后无人照料的可能性，当其在自愿的情形下从事具有一定风险行为时，应当为自己的选择承担预期的后果，须对自己过量饮酒的行为承担主要责任。作为酒宴的组织者和事主，应对来客尽到更多的劝诫以及酒后照顾和安全保障义务。同桌饮酒的人也应当对同桌饮酒的人相互间负有规劝、提醒、照顾的义务，例如劝说同桌饮酒人少喝、提醒饮酒要适量、喝酒后不要驾驶机动车以及对饮酒过量的人负有安全照顾义务等。</span></section><section style='max-width: 100%;
