box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> 为规范河道采砂行为，维护河道河势稳定，保障河道防洪和河道工程安全，依据《陕西省河道管理条例》《陕西省河道采砂管理办法》等法律法规，结合我市实际，现对辖区市县管理河道采砂禁采区、禁采期予以公告。</font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> <strong>一、禁采区</strong></font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> （一）法律法规明文禁止采砂的区域。主要包括:河道防洪工程、河道整治工程、水库枢纽、水文观测设施、水环境监测设施、涵闸以及取水、排水、水电站等工程及其附属设施安全保护范围；河道顶冲段、险工、险段；桥梁、码头、浮桥、渡口、航道、过河电缆、管道、隧道等工程及其附属设施安全保护范围；饮用水源保护区；自然保护区、风景名胜区和湿地公园；依法禁止采砂的其他区域；</font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> （二）根据水情、工情、汛情和管理等需要，由县级以上地方人民政府水行政主管部门临时确定并公告的采砂禁采区；</font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> （三）未编制河道采砂规划的河道（河段）区域。</font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> <strong>二、禁采期</strong></font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> （一）汛期（5月1日-10月31日，若有调整以市防汛抗旱指挥部决定为准）；</font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> （二）河道达到或者超过警戒水位时；</font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> （三）根据水情、工情、汛情和管理等需要，由县级以上地方人民政府水行政主管部门临时确定并公告的采砂禁采期；</font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> （四）依法禁止采砂的其他时段。</font></p><p style='max-width: 100%; box-sizing: border-box; clear: both; min-height: 1em;'><font face="微软雅黑" size="3"> 河道砂石资源属于国家所有，任何单位或者个人不得非法开采。国家建立河道采砂规划和许可制度，在禁采期、禁采区，禁止一切河道采砂活动（水行政主管部门批准或经其他相关河道主管部门许可的河道整治及疏浚工程除外）。非经规划、未经水行政主管部门许可在禁采期、禁采区开采或未按法定程序、未按许可规定的河道采砂行为均视为非法采砂。</font></p><p style='max-width: 100%;
