max-width: 100%; color: rgb(51, 51, 51); font-size: 16px; letter-spacing: 0.5px; box-sizing: border-box !important;'>法院认为，被告人洪峤、张晨光、曹泽青故意非法剥夺他人生命，三被告人的行为均构成故意杀人罪。被告人洪峤、祁文强以非法占有为目的，秘密窃取他人数额较大的财物，二被告人的行为均构成盗窃罪。洪峤犯故意杀人罪、盗窃罪，应数罪并罚。在故意杀人共同犯罪中，洪峤系犯意提起者、策划者、指挥者，并提供作案费用，诱骗被害人至案发地，张晨光与曹泽青积极参与策划、分工合作杀害被害人，三被告人均系主犯，其中洪峤的地位最高，罪责最为突出。洪峤因与被害人恋爱纠纷，精心策划犯罪，指使张晨光、曹泽青将被害人杀害并掩埋，犯罪情节特别恶劣，罪行极其严重，认罪、悔罪态度差，主观恶性深，人身危险性大，依法予以严惩。张晨光、曹泽青在共同犯罪中的罪责小于洪峤，且归案后如实供述犯罪事实，认罪态度好，判处死刑可不立即执行。在盗窃共同犯罪中，洪峤首起犯意，指挥祁文强具体实施盗窃行为，二被告人均系主犯，其中洪峤的罪责更为突出。祁文强到案后主动交代盗窃犯罪事实，构成自首，依法可以从轻处罚。法院遂作出上述判决。</span></span></section><section style='margin-right: 8px;
