令李先生没想到的是，妻子在厨房忙碌一段时间后突然晕倒。“晚上八点四十左右，雇主打电话询问打扫情况。我喊我老婆，没有得到回应，就跑到厨房去看，这才发现她晕倒了。” 躺在病床上的刘女士回忆说：“当时厨房冰箱里的肉烂了，流了一地水，我一进厨房就闻到一股刺鼻的气味。打扫了半个钟头后，突然就晕过去了，之后发生了什么就不知道了。” 晕倒后的刘女士被送往附近的重钢总医院检查，诊断为大脑动脉闭塞脑梗死。<span 钟女士的丈夫也表达了自己的看法：“原本通过派出所调解，考虑到她多年在我家做清洁，我们还打算给她5000元的慰问费。现在竟然觉得我们有错。” 钟女士和丈夫都表示，“一切以法律为准绳，要有事实依据。不是她说让我们出（治疗费）我们就出。如果觉得我们有责任，可以拿出司法鉴定或医学鉴定，通过法院裁决，该怎么赔就怎么赔。” <section data-role="title" rgb(104, 204, 208);'> </section></section></section></section> 那么，从医学角度来看腐烂肉散发的臭味是否会导致突发脑梗呢？ 西南医院神经内科专家后显华表示，脑梗常见的危险诱因主要有高血压、糖尿病、高血脂等，饮食作息不规律、缺乏运动等不良生活习惯都会扰乱内环境代谢紊乱，从而引发脑梗。 “针对该事件，从医学角度来看，腐烂肉散发的臭味与脑梗之间可能并没有直接关系。根据我读过的文献资料，尚未发现臭味能直接导致脑梗的证据。” 后显华医生表示，这事还是得通过法律途径来解决，“建议双方走正常的司法鉴定，我们医院就设有相关的司法鉴定部门。” <section data-role="title" data-tools="135编辑器" data-id="147094"><section 重庆康君律师事务所律师、中华全国律师协会会员祁伟表示，“根据《民法典》相关规定，在个人与个人的劳务关系中，通常适用过错责任原则。该事件中，清洁工在雇主家打扫卫生时突发脑梗，属于在从事雇佣活动过程中遭受的人身损害，雇主可能需要承担相应的赔偿责任。但前提是清洁工一方需要证明雇主家厨房烂肉流出的臭味，与其突发脑梗、脑出血之间存在直接因果关系。” <ul class="list-paddingleft-1"><li>如果雇主明知厨房存在严重的卫生问题而未提前告知或采取措施，可能被认为存在过错，需要承担相应责任。但如果雇主请清洁工来清理臭味，且没有其他过错行为，责任可能会减轻。</li><li>“对于清洁工而言，其作为完全民事行为能力人，应当对工作环境中的潜在危险有一定的判断和防范能力。”祁伟律师说，如果清洁工未能尽到必要的注意义务，也需要承担部分责任。</li></ul>
