size="3">经查，北京萱妍堂生物科技有限公司（以下简称当事人）在某直播平台上，通过其运营的店铺及账号销售“萱妍堂红颜草莓桑葚燃咔果冻”，该果冻为普通食品，无保健品、药品资质。当事人自2024年5月起，从某微信用户处购买跟播服务，为其提供直播间增加人气、互动评论等服务。2024年9月、2024年10月，在当事人直播时，该微信用户先后通过数十个账户在当事人直播间互动评论1500余次，包括“我喝酒夜宵还瘦了7斤，就2盒”“踩过太多坑，没瘦过，吃了你家成功瘦20斤”等话术，以宣传当事人销售的果冻具有减肥效果。该微信用户非“萱妍堂红颜草莓桑葚燃咔果冻”用户，上述评论系虚假用户评价。</font></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">2024年12月，北京市市场监管局依据《网络反不正当竞争暂行规定》第九条第一款第四项、《中华人民共和国反不正当竞争法》第八条第一款和第二十条第一款、《北京市市场监督管理局行政处罚裁量权适用规定（2024年修订）》第十五条第一项的规定，依法作出责令当事人停止违法行为，并处罚款10万元的行政处罚。</font></span></p><p style='margin-bottom: 24px;'><strong><span style='color: rgb(0, 122, 170);'><span leaf=""><font size="3">二、浙江省杭州市余杭区市场监管局查处杭州杰福文化传媒有限公司虚假宣传案</font></span></span></strong></p><p style='margin-bottom: 24px;'><span size="3">经查，杭州杰福文化传媒有限公司（以下简称当事人）与杭州某文化传播有限公司签订合作协议，约定为该公司旗下的“小饼干”直播间的“jovs618超膜刀专场”提供直播运营托管及推广策划服务，负责该专场直播的执行。在该专场直播中，主播根据当事人提供的口播话术，在介绍涉案商品性能时使用了“形成肌肉记忆，不会反弹”“帮你每分钟做十几万次卷腹”等字样，但当事人无法提供与口播话术中相关功效对应的证明材料，构成了虚假宣传商品性能的违法行为。</font></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">2025年1月，杭州市余杭区市场监管局依据《中华人民共和国反不正当竞争法》第八条第一款和第二十条第一款、《浙江省市场监督管理行政处罚裁量基准管理办法》第十三条第二项的规定，依法对当事人作出罚款20万元的行政处罚。</font></span></p><p style='margin-bottom: 24px;'><span style='color: rgb(0, 122, 170);'><strong><span leaf=""><font size="3">三、河南省郑州市市场监管局查处郑州禾兰仕科技有限公司销售不符合国家标准的产品案</font></span></strong></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">经查，2024年10月，郑州禾兰仕科技有限公司（以下简称当事人）在某平台开设店铺，并通过直播带货的形式对外销售某品牌“取暖器（2024语音至尊旗舰款）”，上述取暖器经检测耐热和耐燃（不包括针焰试验）项目不符合国家强制性标准。</font></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">当事人的行为违反了《中华人民共和国产品质量法》第十三条第二款的规定，构成销售不符合国家标准的工业产品的违法行为。2025年3月，郑州市市场监管局依据《中华人民共和国产品质量法》第四十九条的规定，依法责令当事人停止违法行为，并处罚没3.84万元的行政处罚。</font></span></p><p style='margin-bottom: 24px;'><strong><span style='color: rgb(0, 122, 170);'><span leaf=""><font size="3">四、浙江省宁波市海曙区市场监管局查处宁波海曙孙丽服装店侵犯注册商标专用权案</font></span></span></strong></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">经查，2023年11月，宁波海曙孙丽服装店（以下简称当事人）在未经商标权利人许可的情况下，生产并通过某直播平台销售了一批仿冒某知名品牌注册商标的服装。上述服装上的图案标识与某知名公司持有的注册商标整体外观近似，构成商标侵权行为，使相关公众对商品的来源产生混淆。</font></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">当事人的行为构成了《中华人民共和国商标法》第五十七条第二项规定的侵犯注册商标专用权的行为。2025年4月，宁波市海曙区市场监管局依据《中华人民共和国商标法》第六十条第二款的规定，依法对当事人作出没收侵权服装1016件，罚款10.7万元的行政处罚。</font></span></p><p style='margin-bottom: size="3">经查，2024年12月，青岛科曼奇商贸有限公司（以下简称当事人）作为直播间运营者，利用其平台账户直播推广“药王秘制”膏，该产品为普通产品，并非药品、医疗器械产品。当事人在直播销售中提及产品疾病治疗功能，演绎“一老太手因经络不通不能动，使用产品后手部逐渐恢复活动能力”的虚构剧情，误导消费者，演绎中多次使用“湿寒的”“经络不通的”等语言并插入推广产品链接。</font></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">当事人的行为违反了《中华人民共和国广告法》第十七条的规定。2025年3月，青岛市市场监管局依据《中华人民共和国广告法》第五十八条第一款和第三款的相关规定，并综合裁量案件情节，依法对当事人作出责令停止发布违法广告，并处罚款10万元的行政处罚。</font></span></p><p style='margin-bottom: 24px;'><strong><span style='color: rgb(0, 122, 170);'><span leaf=""><font size="3">六、湖北省仙桃市市场监管局查处马某侵犯注册商标专用权案</font></span></span></strong></p><p style='margin-bottom: size="3">经查，马某（以下简称当事人）于2024年12月从武汉市某商城购进羽绒服，并在网上发货销售。2024年12月至2025年1月期间，当事人通过某平台店铺开始由带货主播在直播间销售上述绣制有近似某知名品牌标识的羽绒服。当事人不能提供该知名品牌的商标标识授权使用证明，构成了《中华人民共和国商标法》第五十七条第二项侵犯注册商标专用权行为。</font></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">2025年3月，仙桃市市场监管局依据《中华人民共和国商标法》第六十条第二款的规定，依法作出责令当事人停止侵权行为，没收侵权羽绒服并处罚款20万元的行政处罚。</font></span></p><p style='margin-bottom: 24px;'><strong><span style='color: rgb(0, 122, 170);'><span leaf=""><font size="3">七、广东省广州市白云区市场监管局查处广州创梵速品科技有限公司虚假宣传案</font></span></span></strong></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">经查，2024年8月以来，广州创梵速品科技有限公司（以下简称当事人）签约主播在某平台直播带货销售化妆品、家用电器、咖啡固体饮料等商品过程中，为提高商品销售量，在商品卖点卡宣传内容之外，采取虚构或夸大商品功能及性能等宣传方式欺骗、误导消费者，构成虚假或者引人误解的商业宣传的违法行为。</font></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">2025年1月，广州市白云区市场监管局依据《中华人民共和国反不正当竞争法》第八条第一款和第二十条规定，依法对当事人作出罚款51万元的行政处罚。</font></span></p><p style='margin-bottom: 24px;'><strong><span style='color: rgb(0, 122, 170);'><span leaf=""><font size="3">八、浙江省诸暨市市场监管局查处阮某某直播销售以假充真珍珠案</font></span></span></strong></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">经查，阮某某（以下简称当事人）在某平台直播销售中，将仿珍珠产品和仿珍珠项链充当真珍珠进行销售，相应珍珠鉴定证书均属伪造。当事人的违法销售金额共计59.97万元。当事人的行为违反了《中华人民共和国产品质量法》第三十九条的规定，属于销售以假充真商品的行为。</font></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">当事人通过直播的形式，销售以假充真的珍珠，销售金额巨大，涉嫌违反《中华人民共和国刑法》第一百四十条的规定，构成销售伪劣产品罪。2025年3月，诸暨市市场监管局依法将案件移送公安机关。</font></span></p><p style='margin-bottom: 24px;'><strong><span style='color: rgb(0, size="3">经查，广州辛选网络信息科技有限公司（以下简称当事人）主播在直播推广某品牌“酵母调制乳粉（免疫球蛋白型）”、某品牌食品、某品牌“艾草三伏贴”等商品的过程中，在商品卖点卡宣传内容之外，存在夸大宣传、虚构商品功能性能等欺骗、误导消费者的行为，构成虚假或者引人误解的商业宣传的违法行为。</font></span></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">2025年1月，广州市白云区市场监管局依据《中华人民共和国反不正当竞争法》第八条第一款和第二十条规定，依法对当事人作出罚款175万元的行政处罚。</font></span></p><p style='margin-bottom: 24px;'><strong><span style='color: rgb(0, 122, 170);'><span leaf=""><font size="3">十、新疆维吾尔自治区和田地区墨玉县市场监管局查处和田圣贤珠宝有限公司虚假宣传案</font></span></span></strong></p><p style='margin-bottom: 24px;'><span leaf=""><font size="3">经查，和田圣贤珠宝有限公司（以下简称当事人）于2025年1月与和田某房地产开发有限公司签订租赁合同，租用该公司施工场地及房屋用于拍摄短视频。当事人于2025年1月起在该施工场地正式开启直播活动，雇佣王某进行玉石直播，并设置虚假挖玉场景欺骗直播间观众。在直播前，当事人事先将玉石埋入挖掘机铲子内。直播过程中，当事人雇佣的挖玉人员佯装从挖掘机铲子内挖玉，挖到玉石后递给主播，主播则在直播间内向粉丝介绍这些玉石是现场挖出的，通过这种方式提高直播间人气。当事人上述行为违反了《网络反不正当竞争暂行规定》第八条第一款第二项之规定。</font></span></p><p
