text-indent: 2.42857em;"><strong><span style="font-size: 15px;letter-spacing: 2px;"><span leaf="">一、选址禁止性规定</span></span></strong></p><p style="line-height: 2; text-indent: 2.42857em;"><span style="font-size: 15px;letter-spacing: 2px;"><span leaf="">《中华人民共和国生态环境法典》第二百五十条规定：“禁止在居民住宅楼、未配套设立专用烟道的商住综合楼以及商住综合楼内与居住层相邻的商业楼层内新建、改建、扩建产生油烟、异味、废气的餐饮服务项目。排放油烟污染物的餐饮服务业经营者应当采取有效措施，使污染物达标排放，并防止对附近居民的正常生活环境造成污染。”</span></span></p><p style="line-height: 2; text-indent: 2.42857em;"><strong><span style="font-size: 15px;letter-spacing: 2px;"><span leaf="">二、选址温馨提示</span></span></strong></p><p style="line-height: 2; text-indent: 2.42857em;"><span style="font-size: 15px;letter-spacing: 2px;"><span leaf="">良好宜居环境需要全社会共同维护。请各餐饮经营者自觉遵守法律法规，如您新设的餐饮服务经营场所位于法定禁止区域，请勿申报产生油烟、异味、废气的餐饮服务项目，建议重新选址。</span></span></p><p style="line-height: 2; text-indent: 2.42857em;"><span style="font-size: 15px;letter-spacing: 2px;"><span leaf="">营业执照的办理，登记机关仅对提交材料开展形式审查，不</span></span><span style="font-size: 15px;letter-spacing: 2px;text-indent: 2.42857em;background-color: transparent;caret-color: red;"><span leaf="">对经营场所是否符合环保选址条件进行现场核查，经营场所是否具备专用烟道、是否属于禁设区域，由申请人自行实地核实确认。即使已经取得营业执照，也不代表该场所即符合餐饮环保条件。如果经营地点属于法定禁设区域，后续监管执法部门仍可以依法作出责令改正、关闭、行政处罚等处理，由此产生房租、装修等一切经济损失，由经营者自行承担。</span></span></p><p style="line-height: 2;
