临渭区公开征集违规异地执法、趋利性执法以及“四乱”问题线索

letter-spacing: 1px;">化水平，增强人民群众和市场主体对行政执法的满意度，为我区经济社会高质量发展提供有力的法治保障，</span><span style="font-size: 16px; letter-spacing: 1px; color: rgb(0, 82, 255); background-color: rgb(255, 254, 213);"><strong>现持续公开征集“违规异地执法、趋利性执法以及乱收费、乱罚款、乱检查、乱查封”等问题线索。</strong></span><span style="font-size: 16px; letter-spacing: 1px;"><font face="微软雅黑">一、工作目标</font></span></section><section style="text-size-adjust: 100%; margin-bottom: 14px; color: rgb(51, 51, 51); font-size: 18px; text-indent: 2em; line-height: 2em;"><span style="font-size: 16px; letter-spacing: 1px;"><font face="微软雅黑">以集中整治群众身边不正之风和腐败问题为契机，坚持问题导向、目标导向、结果导向，严肃查处行政执法中的各类顽瘴痼疾。着力健全涉企收费监管、异地执法协作等机制，坚决纠正“远洋捕捞”式执法、将罚款与绩效考核挂钩、以罚代管、重复检查等行为，统一执法标准，深查背后的政绩观错位、以权谋私等问题。推动行政执法理念、方式、作风实现根本转变，建立健全长效机制，切实维护公平竞争的市场秩序和人民群众合法权益。</font></span></section><section style="text-size-adjust: 100%; margin-bottom: 14px; color: rgb(51, 51, 51); font-size: 18px; text-indent: 2em; line-height: 2em;"><span style="font-size: 16px; letter-spacing: 1px;"><font face="微软雅黑">（一）违规异地执法。未经批准跨区域执法、超越管辖权限执法、未按规定程序开展异地执法等。</font></span></section><section style="text-size-adjust: 100%; margin-bottom: 14px; color: rgb(51, 51, 51); font-size: 18px; text-indent: 2em; line-height: 2em;"><span style="font-size: 16px; letter-spacing: 1px;"><font face="微软雅黑">（二）趋利性执法。下达或变相下达罚没款指标、以罚代管、重复罚款等；将罚没收入与执法部门经费挂钩，变相激励执法人员增加罚款额度；选择性执法，针对特定市场主体或群体频繁处罚，谋取不当利益。</font></span></section><section style="text-size-adjust: 100%; margin-bottom: 14px; color: rgb(51, 51, 51); font-size: 18px; text-indent: 2em; line-height: 2em;"><span style="font-size: 16px; letter-spacing: 1px;"><font face="微软雅黑">（三）乱收费问题。违规设立收费项目、随意提高标准、扩大范围、不执行公示制度、不明码标价，不出具票据等行为。</font></span></section><section style="text-size-adjust: 100%; margin-bottom: 14px; color: rgb(51, 51, 51); font-size: 18px; text-indent: 2em; line-height: 2em;"><span style="font-size: 16px; letter-spacing: 1px;"><font face="微软雅黑">（四）乱罚款问题。无处罚依据擅自设定罚款项目、不具备执法资格的单位或者个人实施罚款、未按规定程序实施罚款，滥用自由裁量权，同案不同罚等行为。</font></span></section><section style="text-size-adjust: 100%; margin-bottom: 14px; color: rgb(51, 51, 51); font-size: 18px; text-indent: 2em; line-height: 2em;"><span style="font-size: 16px; letter-spacing: 1px;"><font face="微软雅黑">（五）乱检查问题。检查主体无权限，不具备行政执法主体资格实施检查、检查标准和程序不合法，重复检查、多头检查、超频次检查，检查标准不清、检查随意任性、变相检查，无法定依据或未按照公布的事项、标准及规定程序实施检查等行为。</font></span></section><section style="text-size-adjust: 100%; margin-bottom: 14px; color: rgb(51, 51, 51); font-size: 18px; text-indent: 2em; line-height: 2em;"><span style="font-size: 16px; letter-spacing: 1px;"><font face="微软雅黑">（六）乱查封问题。违反法定条件或权限实施查封、无行政执法资格的人员实施查封、超过法定期限查封、超出合理范围和额度的查封、查封无关人员、违规异地查封，变相查封等行为。</font></span></section><section style="text-size-adjust: 100%; margin-bottom: 14px; color: rgb(51, 51, 51); font-size: 18px; text-indent: 2em; line-height: 2em;"><span style="font-size: 16px; letter-spacing: 1px;"><font face="微软雅黑">同时，深入纠治执法标准不统一、执法行为简单粗暴等问题，严查执法行为背后可能存在的政绩观错位、以权谋私、利益输送等违纪违法问题。</font></span></section><section style="text-size-adjust: 100%;
